We will never sell your personal information. 1600 Avenue is built on trust — with the communities we serve, the donors who support us, and the participants who share sensitive information when they need help. This Policy explains clearly what we collect, why, and what you can do about it.
1. Who We Are
1600 Avenue is a California nonprofit public benefit corporation, tax-exempt under Section 501(c)(3) of the Internal Revenue Code. We operate www.1600avenue.com and deliver programs focused on cybersecurity access, digital education, and community resilience.

1600 Avenue acts as the data controller for personal information collected through our Site and Programs. We are not a covered entity under HIPAA and do not collect health information in the course of our programs.
2. Who This Policy Covers
- Website visitors who browse www.1600avenue.com;
- Individuals who submit intake forms through our Cyber Help Referral Program at /cyber-help;
- Donors who make financial contributions to 1600 Avenue online or offline;
- Volunteers, mentors, and community members who participate in our programs;
- Students and youth participants in Hip Hop Tech Leaders and other educational initiatives (with additional protections for minors);
- Business contacts, prospective partners, and event attendees.
3. What We Collect and Why
3.1 Cyber Help Referral Program
When you submit an intake form at /cyber-help, we collect: your name, email address, the platform affected (e.g. Instagram, email), the urgency level you select, and a description of your situation. This information is collected with your consent, solely for the purpose of connecting you with our partner Yours AI for hands-on cyber recovery support. It is not used for marketing, profiling, or any other purpose.
3.2 Donor Information
- Identity and contact information: name, mailing address, email, phone.
- Donation history: amounts, dates, and methods of contribution.
- Payment information: processed securely by our payment processor. We do not store full credit card numbers.
Donor information is used to process donations, issue tax receipts, send acknowledgment and impact communications (with consent), and fulfill legal reporting obligations. We do not sell, rent, or trade donor lists.
3.3 Volunteer and Program Participant Information
Name, email, phone, and relevant background information provided on volunteer applications or program enrollment forms. For youth participants under 18 we collect only the minimum necessary information with verifiable parental or guardian consent, and apply heightened protections to all youth information.
3.4 Website Technical Data
IP address, browser type/version, device type, operating system, referring URL, and pages visited. Session data such as time on site and navigation paths. Cookie data as described in Section 7.
3.5 Communications
When you contact us by email, phone, or through our Site, we retain records of those communications to respond to your enquiry and maintain our relationship with you.
4. Legal Basis and Consent
4.1 California (CalOPPA and CCPA/CPRA)
We comply with the California Online Privacy Protection Act (CalOPPA) and, where applicable, the CCPA as amended by the CPRA. While CCPA/CPRA primarily applies to for-profit businesses meeting certain thresholds, 1600 Avenue voluntarily adopts CCPA-consistent practices.
4.2 GDPR — EU and UK Users
Where we process personal data of EEA or UK residents we do so on the basis of consent (for cyber help intake and marketing), legitimate interests (analytics and security, balanced through a documented assessment), or legal obligation. EU and UK residents have the rights described in Section 8.
4.3 Consent for Cyber Help Referrals
Submission of the Cyber Help intake form constitutes consent to share the submitted information with Yours AI (1600 Cyber) for the specific purpose of obtaining cyber recovery assistance. Consent may be withdrawn by contacting frank@1600avenue.com.
5. How We Use Personal Information
- To deliver our programs: cyber help referrals, volunteer matching, educational content, and participant support.
- To process donations and issue tax receipts as required by IRS regulations and California law.
- To communicate with you: program updates, volunteer coordination, donation acknowledgments, and impact reports. Marketing and fundraising communications are sent only with your consent.
- To improve our Site and Programs.
- To ensure the safety of program participants, particularly youth.
- To comply with IRS, California Attorney General, and data protection obligations.
We do not use personal information for automated profiling that produces legal or similarly significant effects without human review.
6. Who We Share Information With
We do not sell, rent, or trade your personal information. We share it only in these limited circumstances:
- Yours AI / 1600 Cyber: Cyber Help intake data is shared with Yours AI solely to facilitate your referral, with your prior consent. Yours AI processes this data under its own Privacy Policy at www.yoursai.ai/privacy.
- Service providers: Trusted vendors (payment processing, email delivery, hosting) required to protect your information and use it only for services to 1600 Avenue.
- Legal requirements: When required by law, court order, or to protect the safety of participants or the public.
- IRS and California Attorney General: As required for nonprofit registration and tax compliance. Donor names may appear on Form 990 Schedule B (filed with the IRS, not made public by us).
- Program partners and co-sponsors: Disclosed on the relevant program page, sharing only the minimum necessary information under appropriate agreements.
7. Cookie Policy
We use cookies to operate our Site and understand how it is used. We do not place non-essential cookies without your consent, minimize tracking and advertising cookies, and do not use cookies to serve targeted advertising.
- Strictly Necessary (no consent required): session management, security, and cookie preference storage.
- Functional (consent required): remembering your preferences between visits.
- Analytics (consent required): anonymized data about Site usage.
- Google Ad Grants Tracking: Google may set cookies to measure grant-funded ads under Google's own privacy policy. Not used for profiling or retargeting.
8. Your Privacy Rights
8.1 California Residents — CPRA Rights
- Right to Know what personal information we collect and share.
- Right to Delete your personal information, subject to legal exceptions.
- Right to Correct inaccurate information.
- Right to Opt Out of Sale or Sharing: we do not sell personal information. Use the tool below to opt out of any sharing that may be considered "sharing" under California law.
- Right to Non-Discrimination for exercising these rights.
- Donor Opt-Out: donors may opt out of sharing their name and contact information with third parties for marketing at any time.

8.2 Email and Marketing Opt-Out
All marketing and fundraising communications include a clear unsubscribe link. You may also opt out by emailing frank@1600avenue.com. We action opt-out requests within 10 business days.
8.3 GDPR Rights — EEA and UK Residents
EEA and UK residents have the right to access, correct, request erasure, restrict or object to processing, request data portability, and withdraw consent. We respond to privacy rights requests within 30 days and do not charge a fee for reasonable requests. You may also lodge a complaint with your local supervisory authority.
9. Children's Privacy
Our Hip Hop Tech Leaders program and other youth initiatives serve participants who may be under 13 or under 18.
- Under 13 (COPPA): minimum-necessary collection, verifiable parental consent before collecting personal information, no sharing of minors' information for marketing, and parent right to review, correct, or delete.
- Under 18: parental or guardian consent required and heightened confidentiality protections applied.
- Under GDPR (under 16): verifiable parental consent required for EU residents.
10. Donor Privacy Commitment
- We will not sell, trade, or share donor lists for marketing or fundraising.
- We will not contact donors for purposes unrelated to 1600 Avenue without consent.
- We acknowledge qualifying donations with written receipts as required by the IRS.
- Donors may request to remain anonymous in public communications.
- Donors may opt out of communications at any time.
- We will not disclose donor information to government bodies except as required by law (e.g. IRS Form 990 Schedule B).
11. Data Security and Retention
We implement TLS-encrypted data transmission, secure storage with access controls, regular security reviews, and staff training. We retain personal information only as long as necessary:
- Donor records: 7 years from date of donation.
- Cyber help intake data: 90 days after referral completion, then deleted unless legal or safety retention applies.
- Volunteer and participant records: duration of program relationship plus 3 years.
- Website log data: 12 months.
- Email communications: 3 years from last interaction.
12. Third-Party Sites and Partner Links
Our Site links to Yours AI (www.yoursai.ai) and 1600 Cyber (www.1600cyber.com), operated by separate legal entities with their own privacy policies. When you leave our Site you are subject to the destination's privacy practices.
13. International Users and Data Transfers
1600 Avenue is based in California, USA. If you access our Site from outside the United States, your information will be transferred to and processed in the United States. For EEA and UK users we rely on Standard Contractual Clauses or other appropriate transfer mechanisms where required.
14. Global Privacy Control (GPC)
We recognize Global Privacy Control opt-out preference signals. If your browser transmits a GPC signal, our system automatically opts you out of tracking on this device.
15. Changes to This Policy
We may update this Policy periodically. Material changes will be posted on our Site with the updated effective date and, where practical, communicated to registered users and donors by email with at least 30 days' notice.
