Terms and Conditions

Access to technology and cybersecurity is an unalienable right. 1600 Avenue is a California 501(c)(3) nonprofit corporation dedicated to ensuring that every person — regardless of income, background, or location — has access to cybersecurity help, digital education, and the tools to stay safe online. These Terms govern your use of our website and programs. By using our site, you agree to them.

1. Who We Are

1.1 Organization Identity

These Terms and Conditions ("Terms") govern your use of the 1600 Avenue website at www.1600avenue.com ("Site") and all programs, services, and resources made available through the Site (collectively, "Programs").

1600 Avenue ("Organization", "we", "us", "our"): 1600 Avenue is a California nonprofit public benefit corporation, tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Our principal office is located in California. We are registered with the California Attorney General's Registry of Charitable Trusts and file annual reports as required by the California Nonprofit Integrity Act of 2004.

You / User: Any individual, organization, donor, volunteer, program participant, course buyer, or visitor who accesses or uses the Site or our Programs.

1.2 Our Mission

1600 Avenue's mission is to ensure that access to cybersecurity education, digital protection tools, and a safe internet is available to everyone, with a particular focus on underserved communities, youth, seniors, families, small businesses, and organizations that would otherwise go without. Our programs include the Hip Hop Tech Leaders youth program; the Cyber Help and Referral Program (in partnership with Yours AI); cybersecurity awareness workshops and community events; and our Information Sharing and Analysis Organization (ISAO) cyber resilience initiative.

1.3 Relationship to 1600 Cyber and Yours AI

1600 Avenue maintains a partnership with 1600 Cyber and Yours AI for the purpose of delivering hands-on cyber recovery support and digital independence resources to our community. 1600 Avenue does not receive payment per referral from 1600 Cyber or Yours AI. Any referral is made solely in furtherance of our nonprofit mission and not for commercial gain. 1600 Cyber and Yours AI operate under separate Terms and Privacy Policies available at www.yoursai.ai and www.1600cyber.com.

2. Acceptance of Terms and Eligibility

By accessing the Site or participating in any 1600 Avenue Program, you confirm that: (a) you have read and agree to be bound by these Terms; (b) you are at least 13 years of age, or have consent of a parent or guardian if you are under 18; and (c) you will use the Site and Programs only for lawful purposes consistent with our mission and these Terms. These Terms do not create any employment, volunteer, contractor, partnership, or agency relationship between you and 1600 Avenue unless separately agreed in writing.

3. Programs, Services, and Cyber Help Referral

3.1 Nature of Our Programs

1600 Avenue offers educational programs, community resources, cyber help referrals, workshops, and awareness content. Nothing on our Site or in our Programs constitutes professional legal, financial, medical, or cybersecurity advice, and no client or professional relationship is created by your use of the Site or Programs.

3.2 Cyber Help Referral Program

Our Cyber Help Referral Program at /cyber-help is provided free of charge as part of our mission. When you submit an intake form, you are requesting a referral to our partner Yours AI for hands-on cyber recovery support. 1600 Avenue does not itself provide technical cybersecurity remediation services. The referral is voluntary, and you are not required to use or pay for any Yours AI service as a condition of receiving 1600 Avenue's community resources.

3.3 Eligibility for Programs

Specific programs may have eligibility requirements (age, geography, enrollment criteria) described on the relevant program page. 1600 Avenue reserves the right to determine eligibility in its sole discretion consistent with our mission and applicable grant requirements.

3.4 No Guarantee of Outcome

1600 Avenue makes no guarantee regarding the outcome of any cyber help referral, educational program, or community resource. Account recovery from third-party platforms is determined by those platforms, not by 1600 Avenue or its partners.

4. Donations

4.1 Tax Deductibility

Donations to 1600 Avenue are tax-deductible to the extent permitted by law. We provide written acknowledgment of donations as required by IRS regulations. Our EIN and registration details are available upon request.

4.2 Use of Donations

Donations fund our charitable programs and operations in furtherance of our mission. We do not pay commissions or finders' fees in connection with charitable solicitations. By donating you confirm your donation is a voluntary charitable gift and not a payment for goods or services.

4.3 Charitable Solicitation Registration

1600 Avenue is registered with the California Attorney General's Registry of Charitable Trusts as required under Government Code Section 12580 et seq. and solicits donations in accordance with California and federal law.

4.4 Refunds

Donations are generally non-refundable. If you believe a donation was made in error, contact frank@1600avenue.com within 30 days and we will review the request case by case.

5. Volunteers and Community Participants

Volunteers, mentors, and program participants participate voluntarily and without compensation unless separately agreed in writing. Volunteers are not employees and are not entitled to employment benefits. By participating, you agree to comply with these Terms and applicable program guidelines, treat all participants with dignity and respect, and maintain the confidentiality of personal information about program participants you encounter.

6. Intellectual Property

6.1 Our Content

All Site content — text, graphics, logos, images, curriculum, and program resources — is owned by or licensed to 1600 Avenue and protected by copyright and trademark law. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent. You may share our content for personal, educational, and non-commercial purposes provided you attribute 1600 Avenue and link to www.1600avenue.com.

6.2 No Resale of Resources

1600 Avenue's educational materials, curriculum, program resources, cyber help referral services, and community content are provided free of charge as part of our charitable mission. Resale or redistribution for commercial gain without express written consent is prohibited.

6.3 Third-Party Content

Our Site may link to or incorporate content from third parties, including Yours AI and 1600 Cyber. Such content is subject to those parties' own terms and is not owned or controlled by 1600 Avenue.

7. Acceptable Use

You agree not to use the Site or Programs to:

  • submit false, misleading, or fraudulent information in any intake form or program application;
  • impersonate 1600 Avenue, its staff, partners, or any program participant;
  • collect or harvest personal information about other users without consent;
  • transmit spam, malware, or other harmful content through any Site feature;
  • use the Site to promote commercial products or services without authorization;
  • interfere with the security or operation of the Site or connected systems;
  • violate any applicable law, including laws protecting the privacy or civil rights of participants.

8. Google Ad Grants and Advertising Disclosure

1600 Avenue participates in the Google Ad Grants program. Our use of Google Ad Grants complies with Google's Ad Grants Policy: ads link to pages that directly further our nonprofit mission and are not used primarily for commercial lead generation. Where our Site links to Yours AI or 1600 Cyber, such links are genuine mission-aligned partner referrals disclosed as such; 1600 Avenue receives no payment per click or referral conversion.

9. Disclaimer of Warranties

The Site and all Programs are provided "as is" and "as available" without warranty of any kind, express or implied. 1600 Avenue makes no warranty that the Site will be uninterrupted, error-free, or free from viruses or harmful components. Educational content is provided for informational purposes and does not constitute professional advice. Nothing on this Site creates an attorney-client, therapist-client, or other professional relationship.

Nothing in these Terms limits any non-excludable rights you may have under California consumer protection law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, 1600 Avenue and its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Programs, however caused.

In no event shall 1600 Avenue's aggregate liability to you exceed the amount of any donation you have made to 1600 Avenue in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

Nothing in these Terms limits liability for (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded by California law.

11. Indemnification

You agree to indemnify and hold harmless 1600 Avenue, its directors, officers, employees, volunteers, and agents from any claims, losses, damages, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Site or Programs in violation of applicable law; or (c) your violation of the rights of any third party, including program participants.

12. Privacy and Data Protection

Your use of the Site is also governed by our Privacy Policy, incorporated into these Terms by reference. Key commitments: we do not sell your personal information; donor information is held in confidence and not shared with third parties for their own marketing purposes; Cyber Help referral data is shared only with Yours AI for the limited purpose of delivering the referral, with your consent; and we comply with CalOPPA, the CCPA as amended by the CPRA, and COPPA with respect to users under 13.

13. Third-Party Links and Partner Resources

Our Site contains links to and integrations with third-party websites, including Yours AI (www.yoursai.ai) and 1600 Cyber (www.1600cyber.com). 1600 Avenue is not responsible for the content, privacy practices, or terms of any third-party website.

14. Changes to These Terms and Access

We may update these Terms at any time. Material changes will be posted on the Site with the updated effective date and, where practical, communicated to registered users by email. Continued use of the Site after the effective date constitutes acceptance. 1600 Avenue reserves the right to suspend or terminate access to the Site or any Program for violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in California. As a nonprofit, we encourage resolution of disputes through good-faith discussion before formal proceedings.

EU residents: to the extent our Site is accessible to individuals in the European Economic Area, processing of EU residents' personal data is governed by the GDPR as described in our Privacy Policy. EU residents may also contact their local supervisory authority.

16. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and 1600 Avenue regarding the Site and Programs.

Severability: If any provision is found unlawful or unenforceable, it is severed without affecting the remaining provisions.

No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

Accessibility: We are committed to making our Site accessible to all users. If you encounter barriers, contact frank@1600avenue.com.

IRS Public Disclosure: Our Form 990, Articles of Incorporation, and determination letter are available for public inspection upon request.
